In open court, John R. Barry and Elizabeth K. Barry, minor heirs of Joseph S. Barry, Dec'd, chose Marcellus Barry as their Curator. A bond of $500 was given. Court ordered the appointment of Marcelmus Barry as their Curator. [Given name spelled both as Marcellus and as Marcelmus.]

[Evidence of a Curatorship or Guardianship should date back to 1845-1846 in Morgan County, Missouri, but those records have not been found. It would appear the above proceedings were the result of Marcelmus turning age 21, at which time the family was living in Cole County and he could serve as Curator. What's odd about this Curatorship, as to John R. Barry, is why it appears to have continued past 1856, the approximate year he attained age 21. No settlements after 1859 were found. Note Marcelmus died before 5 Oct 1859.]

Sarah J. Legg to Eli Strong and Elizabeth K. Strong his wife, all of Moniteau Co.; $80 for the interest of John R. Barry in the SW1/4 of the NW1/4 and the SE1/4 of the NW1/4 [and the SE1/4 of the NW1/4 -- repeated in error] and the NW1/4 of the NW1/4 of Sec. 16, Twp. 44, Range 16, containing about 120 acres.

[This deed should be considered in connection with a deed by S. H. Legg, the Administrator for the Estate of Marcelmus Barry, Dec'd, the brother of John R. Barry, to Eli Strong. See Events for Eli Strong. These two deeds describe the same property, suggesting the property was owned by both Marcelmus and John R. Barry. Query by what authority Sarah, who was the mother of both Marcelmus and John as well as the mother of Elizabeth K. Strong, conveyed John's interest. S. H. Legg, the Administrator of Marcelmus' Estate, was a stepson of Sarah's.]
