He is included as a son of James because his presumed date of birth (before 1799 or 1801, i.e., 21 years before the date of his marriage, depending upon whether you use the date on the bond or the marriage return) predates the marriages of any of the other candidates. Noted events in his life were: 1. Census: 1820, Wayne County, Kentucky. 3 Flemming married Betsy JONES on 1 Aug 1822 in Wayne County, Kentucky.1 Marriage Notes: Franklin, Flemming and Betsy Jones. Surety, John Grimes. Bond dated 31 Jul 1820, married 1 Aug 1822 by James Lear. Daughter of William Jones. [Bork calls attention to the dates of the bond and the marriage return.
