Elijah FRANKLIN

  Research Notes:

The 1813 deed as elaborated upon by the 1821 deed establishes Elijah was a son of William.

My research into Elijah has been limited to the time when he lived in Wayne Co., KY. Other than his marriage, information about his family and where he lived after he left Wayne County about 1813 was obtained from information provided to Franklin Family Researchers United by Jean Davis Duckworth.

Although he is not shown in the records of Jean Davis Duckworth, I believe Patsy Morris makes a credible case that William J. Franklin, born about 1818, may be another son of Elijah and Elizabeth. Not only do the 1830 and 1840 censuses show an otherwise unidentified son of William's age in their household, but William J. and family lived not far from Elijah in the 1850 census for Clark Co., AR. Moreover, most of the censuses show he was born in AL, which is where Elijah resided in 1818. Unfortunately, the censuses are not consistent as to his state of birth -- KY and AR are also listed. Since Patsy is not yet satisfied the relationship has been proven, I have not included him as one of the children. Personally, I expect he was. Also, Elizabeth Bawden has called my attention to three Franklin women in Madison Co., AL, who are probably connected to this family in some way. They are Margaret Franklin, May or Mary Franklin and Jane Franklin. Per Elizabeth, Margaret was born about 1800 in KY, married William Robertson on 30 Aug 1816 in Madison Co., AL, lived next door to Elijah Franklin in the 1830 census, and named a son Elijah Franklin Robertson. Per Elizabeth, May or Mary Franklin was born before 1800, married Michael Winford in Feb 1817 in Madison Co., AL, and appears to have been Margaret's sister, since when Michael Winford was appointed administrator of the Estate of William Robertson, Dec'd, he was identified as a brother-in-law. Per Elizabeth, Jane Franklin married John Winford, brother of Michael, in Jan 1817 in Madison Co., AL. Identifying the parents of these Franklin women is complicated by the fact that Elijah did not marry Elizabeth Cocke until 1807, and William and Nancy may have been too old to be their parents. No earlier marriage for Elijah has been found, although there is evidence in an 1804 court document of an illegitimate child. Elijah's household in the 1810 census for Wayne Co., KY contains three unidentified females and William's household contains one. 1802: Franklin, Elisha; 1 white male 21+; 1 horse/mare (I've concluded this entry was probably for Elijah, since entries for Elisha do not otherwise begin until 1806).

1803: Franklin, Elijah; 130 acres, Elk Spring; 1 white male 21+; 1 horse/mare.

1804: Franklin, Elijah; 1 white male 21+.

1805: Unreadable.

1806: Franklin, Elijah; 1 white male 21+; 1 horse/mare.

1807: No entry.

1808: No entry.

1809: Franklin, Elyah; 130 acres, East Fork (?); 1 white male 21+; 1 black; 4 horses/mares.

1810: Franklin, Elijah; 130 acres, _____; 1 white male 21+; 1 black male 16+, 3 blacks total; 6 horses/mares.

1811: Franklin, Elijah; 1 white male 21+; 4 horses/mares.

1812: Unreadable.

1813 on: No more entries for Elijah. There are entries in 1813 and 1814 for Eliha, but these are thought to be for Elisha who remained in Wayne Co.

3. Bondsman: 1802, Wayne County, Kentucky. ⁶

Elijah Franklin was the surety for the bond, dated 26 Oct 1802, for the marriage of John Morris and Sally Franklin. An endorsement on the bond reads, "Elijah Franklin asserts the consent of his father."

4. Court: 1804, Wayne County, Kentucky. ⁷

May Court, 1804:
"County vs. Franklin on a recognizance the defendant being solemly called appeared & said he had no defense to make whereupon it is ordered by the Court that he be charged with the support of the child, to wit, five pounds per year for eight years" Elijah executed a bond for forty pounds and his securities, Robt Mills and James Mur, executed a bond for forty pounds. Neither the mother nor the child was identified.

Elijah married Elizabeth COCKE about 19 Dec 1807 in Wayne County, Kentucky.¹ (Elizabeth COCKE was born about 1790 ² and died before 1850 in Clark County, Arkansas ².)
