David has been listed as a son of John Lear, Jr. and his wife Jemima for two reasons: (1) When David makes his first appearance on the Culpeper County, Virginia tax lists in 1789, presumably at or near the age of 21, he is listed in the same tax district as John Lear (Jr.), who at that time was the only Lear in Culpeper County old enough to be his father; and (2) David appears to have had a daughter named Jemima, who married John Henson/Hanson in Wayne County in 1819, with David providing the bond.

Will of David Lear, Deceased
Dated 29 May 1843, Proved Oct 1843, Book K:590

In the name of God Amen

I David Lear of Garrard County being weak and infirm in body but of sound and disposing mind and memory, do make constitutute ordain and publish this my last will and testament.

1st My wish and desire immediately after my decease that all my Just debts and funeral expenses be paid -

2nd I wish my beloved wife Lucy Lear to have all my estate both real and personal of what nature or Kind soever for and during the term of her natural life -

3rd I wish after the death of my wife Lucy for my estate that she has had in her possession to be equally divided by sale on a credit of twelve months, except me negro man Heavis and Fellis his mother which I shall otherwise direct, between all my children and representatives except Mary Fletcher. She is to have one choice cow and calf more than the rest -

4th my wish and desire that my Negro man Heavis above named is not to be sold to the highest, to be appraised by three disinterested men appointed by the Garrard County Court and have the rite to choose his own master -

5th I wish if my nego woman Fellis above named should live longer than my wife she is to have liberty to choose her a home with some of my children and if they should refuse to take her then and in that case she is to be allowed a support out of my Estate;

And lastly I do hereby constitute and appoint my son Claibourne Lair and Hugh Logan executors of the my last will and testament with full and complete power to carry the same into effect. and to sell my landed estate and convey the same and to be as binding as if I had conveyed it in my own life time -

hereby revoking all other or former wills or testaments by me heretofore made. In Witness whereof I have herein set my hand and offered my sea this 29th day of May in the year of our lord 1843."
